These Terms and Conditions set the rules for using our website and services. By accessing the site, requesting a quote, scheduling service, or buying products, you agree to these Terms.

1) Who may use the site

You must be at least 18 years old and able to enter a binding contract. You agree to use the site only for lawful purposes and in compliance with these Terms.

2) Quotes, orders, and payment

• Quotes are estimates based on information you provide and on-site conditions. Final pricing may change after inspection.
• Orders are accepted when we send a written confirmation. We may refuse or cancel any order and will refund any amounts paid for a canceled order.
• Payments are due as stated on invoices. You authorize us and our payment processors to charge your selected payment method. You are responsible for taxes, fees, and late charges where applicable.

3) Scheduling, access, and site conditions

• You agree to provide safe access to the work area and to disclose relevant site conditions, including plumbing, electrical, and structural limitations.
• If conditions differ from what was disclosed or reasonably expected, additional charges or follow-up visits may be required.
• Missed appointments or no-access visits may incur a reasonable fee.

4) Installation, equipment, and maintenance

• We install equipment according to manufacturer specifications and local codes where applicable.
• Title to equipment passes to you upon full payment unless a financing agreement states otherwise.
• Proper operation requires periodic maintenance, salt or media replacement, and compliance with instructions. Failure to maintain equipment can void warranties.

5) Product and service warranties

• Manufacturer warranties apply to covered products. We pass through those warranties to you and do not enlarge or modify them. Please review the manufacturer’s written terms.
• Our labor warranty, if offered, is limited to the period stated on your invoice. Remedies are repair or re-performance of services at our option.
• Except for the limited warranties above, all products and services are provided “as is” and “as available,” to the maximum extent permitted by law.

6) Water testing and performance

• In-home water tests provide indicative results and are not a certified laboratory analysis. Water softeners treat hardness and related scale. They do not address every possible contaminant.
• Performance depends on incoming water quality, usage, maintenance, and site conditions. Results can vary.

7) Returns, cancellations, and refunds

• Custom orders, installed equipment, used consumables, and special-order parts may be non-returnable.
• Uninstalled stock items may be returnable within 30 days if unused and in original packaging, subject to inspection and a restocking fee.
• Service appointments can be canceled or rescheduled with reasonable notice. Fees may apply for late cancellations or missed appointments.
• Refunds, when approved, are issued to the original payment method.

8) Communications and SMS terms

By providing a phone number or email, you consent to receive messages about quotes, appointments, invoices, and service updates. Message and data rates may apply. Reply STOP to opt out of texts. We may still send transactional or legally required messages.

9) Accounts, content, and acceptable use

• If you create an account, you are responsible for keeping credentials secure and for all activity under your account.
• You must not misuse the site, interfere with its operation, attempt to access it by automated means, or submit unlawful, defamatory, or infringing content.
• If you post reviews or feedback, you grant us a nonexclusive license to use, display, and share that content for marketing and service improvement.

10) Prices, availability, and changes

Prices, promotions, product descriptions, and availability are subject to change without notice. We may modify or discontinue the site or any service. If a material change affects an existing order, we will notify you and offer options.

11) Third-party services

The site may link to or integrate third-party tools, such as payments, scheduling, analytics, or maps. Those services are governed by their own terms and privacy policies. We are not responsible for third-party practices.

12) Intellectual property

All site content, logos, graphics, and software are owned by us or our licensors and are protected by law. You receive a limited license to access and use the site for personal, noncommercial purposes. No resale, republication, scraping, or derivative use is allowed without written permission.

13) Disclaimer of warranties

To the maximum extent permitted by law, the site and all products and services are provided “as is” and “as available.” We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant

uninterrupted or error-free operation.

14) Limitation of liability

To the maximum extent permitted by law, Soft Water Utah will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, or loss of goodwill. Our total liability for any claim will not exceed the amount you paid for the product or service that gave rise to the claim.

15) Indemnification

You agree to defend, indemnify, and hold harmless Soft Water Utah and our owners, employees, and agents from claims, damages, losses, and expenses arising from your use of the site or services, your violation of these Terms, or your violation of any law or third-party right.

16) Dispute resolution, arbitration, and governing law

• These Terms are governed by the laws of the State of Utah, without regard to conflict of law rules.
• Any dispute or claim between you and Soft Water Utah that arises from these Terms or the site or services will be resolved by binding individual arbitration administered by a recognized arbitration provider. Small claims court remains available for eligible claims.
• Class actions and class arbitrations are not allowed.
• You may opt out of arbitration within 30 days of your first agreement to these Terms by emailing info@ezwaterutah.com with subject line “Arbitration Opt Out,” and by including your full name, phone number, and the statement that you wish to opt out.

17) Force majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including supply chain issues, labor shortages, utility outages, extreme weather, and similar events.

18) Changes to these Terms

We may update these Terms at any time. The Effective date shows when the latest version took effect. Your continued use of the site or services after changes means you accept the updated Terms.
